I like the idea of collecting the taxes but withholding them until they stop committing the abuses. 47 has thrown the constitution out the window. He’s not going to use a constitutional argument to force the States to do anything. Same with the SC. They are twisting and turning the Constitution into a pretzel. Same with Congress. Watching the debate on continuing government funding and the Jack Smith testimony proved that. The bold face bullshit being spewed by the Republican liars yesterday was more proof how deep the swamp goes. Thanks, Lisa and Public Notice. One day at a time is all we can do.🙄
I hope states do take action to withhold taxes —both state and individual—from the federal government. The thought of my dollars supporting the abuses makes me sick and furious!
I would like to see several states withholding the funds in a joint effort. If not for any other reason than to get congress to start following the constitution. The civil war is still ongoing.
The parallels to the states' rights arguments of the Confederates are inescapable -- and now the neo-Confederates are, in effect, running the federal government. Or trying to. Jim Crow ruled the South for almost a century after the Civil War ended, never completely disappeared, and has been a strong undercurrent in every Republican administration from Nixon onward. What too many white people, especially those in official positions, have been agonizingly slow to realize is that behind "the masses" (now renamed MAGA) are the oligarchs, the plutocrats, the capitalists, whatever you want to call them. They don't have the votes but they do have the money, and thanks in large part to the Supreme Court money talks louder than ever.
It is rather tragically comical that a man convicted of 34 counts of felony fraud is so concerned about some minor fraud in MN. trump is like a mob boss, if you don't pay me, your life will be worse than I have made it already. Dems scratch their heads trying to figure out legal ways to fight against illegal actions. Blue states have to do something even if it's wrong. The idea of banking federal taxes and not sending them to the trump mob fed is an excellent idea that should be attempted immediately. The states could hold the money and earn interest which could then be sent back to taxpayers after the criminal, corrupt trump admin starts following the law. Dems act insane. They continue to do the same things and expect different results, trump will keep punching blue states in the face until blue states start fighting back. Maybe a compact between blue states would show force in numbers. Blue states subsidize fascist red states. It's time to change tactics or keep getting pummeled by the trump mob.
There’s simply no place for a state to interpose itself as to the payment of income tax. 26 USC 6151(a) pretty plainly states: “Except as otherwise provided in this subchapter, when a return of tax is required under this title or regulations, the person required to make such return shall, without assessment or notice and demand from the Secretary, pay such tax to the internal revenue officer with whom the return is filed, and shall pay such tax at the time and place fixed for filing the return (determined without regard to any extension of time for filing the return).”
Paying to a state in place of The Secretary or the Secretary’s delegate would still incur the dreaded Failure To Pay Penalty specified in 26 USC 6651. These are all interesting happy thoughts, I suppose. There’s simply no loophole to wriggle through in the Internal Revenue Code to make them happen. I don’t particularly want to get into the nastiness of Trust Fund Recovery Penalty but that could come into play against businesses not making their quarterly 94X filings with attached payments as that would also damage people’s standing in Social Security.
There’s no secession-lite which is what today’s newsletter effectively proposes. Just drop the hammer. Our country is on its second constitution after the Articles of Confederation did poorly. As scary as it may seem, it is okay if we need to restructure and reorganize away from the form of government this country has had for so long. It clearly isn’t functioning correctly. Realistic plans for a vibrant future are better than non-starters.
I’m pretty sure taking chances and being brave is the only way out of this at this point! I appreciated this article because this is a question. I have seen come up a lot and have wondered about it myself!
Also, what if other countries stopped transacting in your currency, stopped buying your debt by buying Treasury bonds (the same debt that is funding the US to invade them), and decided to tell the truth that the US stock market is 7 AI companies named “Moe” who endlessly lend debt to each other. Otherwise, they are flat-lined. So what if we all stopped buying into the US’s fantasy about itself and they had to pay their own bar bill? What then?
I shall press my state, which now is being invaded by ICE, to collect and withhold taxes—this is an excellent concept; thank you for it. I'm elderly and self-employed, but his past year I didn't pay my federal estimated taxes. This makes April even more of a nightmare, given my current financial position, but I'm not willing to follow the laws when those who benefit from the laws don't.
Perhaps states that would stop forwarding federal taxes to the federal government could take the collected taxes and apply them in lieu of the withheld federal funding. Those 14 Medicaid programs that are illegally deprived of $515M every quarter would be paid directly by MN's 'federal tax payment fund'. Sounds illegal - but so is the federal government not making the mandated payments in the 1st place. Even if MN loses in court, it would take time. And it might go hand in hand with a court decision requiring the feds to make the payments, so a wash financially.
Maybe Blue States sue the government for failing to comply with the obligation of the regime to disburse funds in accordance with federal law. Ask the court to impose liens on federal property as relief. Then foreclose. Buy the property in at foreclosure, and sell it at leisure. In the meantime, kick out the officials. You'd have to leave the courts in place, but there is property all over the states owned by the feds.
If we could organize to create a larger escrow fund - California, Maine, Minnesota etc. not to release the tax money to the Fed until they stop subjecting us to this violence
While I am completely sympathetic to these suggestions, they have an almost zero chance of succeeding. You wrote, referring to the idea of states collecting federal taxes but not remitting them: "There’s no telling what the administration would do if this happened." The administration would probably bring criminal charges against a large number of state officials because there are a lot of criminal statutes in the Internal Revenue Code to prevent this type of behavior. I do wonder, however, if states could "slow down" the remits to the federal government. This would also have financial consequences for the federal government. There are laws and regulations about how often states have to remit federal taxes, but maybe these can be stretched without incurring civil and criminal charges.
When it comes to what the trump regime could/would do in retaliation I could see them using withholding funds as an excuse to invoke the insurrection act and send troops in.
Hell, I wouldn't put it past trump or miller to order a nuclear strike on home soil to destroy their perceived enemies.
It's what we've got until we decide it's just not working for us. Right now, we pay for things that many of us reject, with no recourse. We are subject to the capricious impulses of a madman and his hateful accomplices. We have no voice and no effective means of changing anything under the current structure. This lack of any power, being forced to abide by their rules with no protection from abuse, is not sustainable.

Why am I paying for ICE? That is self-sabotage.

"trump is like a mob boss" If I may, I would change this to say that the orange pedophilic sadist "IS a mob boss."
I can't argue with that addition.
Just became a paid subscriber to help support mn! thank you
Thanks much! Really appreciate it
