It lists a bunch of "indicia" that somehow add up to domestic terrorism, including fun things like being Anti-Christian and "hostility towards those who hold traditional American views on family, religion, and morality." (notably undefined, though I think the corruption probably isn't one of those traditional views). Then trump imagines up an "organization" which he labels Antifa" and calls it a domestic terrorist organization. As we all know, it isn't an organization; some subgroups may call themselves that, but it isn't at all wide spread.
Being a "domestic terrorist" isn't actually a crime in the US Code. The term is simply used as a sentence enhancer for crimes COMMITTED in a context that the actual statutory definition fits--which does not include protest. But first you have to have a crime and it has to be at a minimum an act "dangerous to human life." Even spitting at an ICE agent doesn't qualify, unless you happen to be a venomous toad.
And to show conspiracy you also need to have a root crime. Agreeing to meet at a protest isn't one. And it is my understanding that the agreement has to be a) to commit an illegal act with b) the intent to carry out such an act c) with the knowledge of EACH member of the agreement.
So the Texas cases were just dead wrong: only those who KNEW one of the group would shoot the cop and agreed in advance that it should be done. I am hoping those convictions are on appeal, though I haven't been able to find any updates.
There is one interesting thing about the Federal Conspiracy Statute, 18 US Code 371:
"if, however, the offense, the commission of which is the object of the conspiracy, is a misdemeanor only, the punishment for such conspiracy shall not exceed the maximum punishment provided for such misdemeanor." Making someone drop a notebook doesn't strike me as a felony.
DOJ will probably try to use 18 U.S. Code § 372 - Conspiracy to impede or injure officer. But are we to believe that they ALL conspired to prevent "by force, intimidation and threat" an ICE officer by brake checking ICE vehicles
